1. General information

These Terms of Use (the "Terms") constitute a legally binding agreement between you, either personally or on behalf of an entity ("you" or "the user") and House of Sahara registered with legal address at Tiursvingen 21, 1407 Vinterbro, NO921367627 (referred to as "HoS", "we", or "Us"), regarding your access to use the website www.houseofsahara.com and other online products or services offered through the website using either via PC, tablet or telephone (collectively "Website").

You must be at least 18 years old. If you are under 18 years of age, you must have permission from a guardian to make order on HoS.

 

We reserve the right to change these terms from time to time without your prior notice. The version of the Terms to which your order is subject is the one available at houseofsahara.com at the time you send the order.

Information and images on the website are owned by the company or partner and may not be copied without permission.


Your contact information will only be visible and processed by Houseofsahara and our partners. Your contact information will never be sold or otherwise distributed to third parties without your consent.

 

2. Prices

All prices showned on houseofsahara.com is excluding any tax, custom & duties and shipping fee. In the shopping cart you see the total price including shipping fee. We reserve the right to make typographical errors and price adjustments. In the event of incorrectly priced items, HoS reserves the right to cancel the order. HoS is not responsible for any customs duties, taxes and/or customs processing fees, charges incurred on international deliveries

 

3. Reservations about sold out items

All items that are presented in the online store are in stock (unless otherwise stated). Stock status is updated regularly, and we reserve the right to minor deviations. Should any of the items in your order be sold out due to errors in stock, you will be contacted by email and credited for the item (s) and we may return the money if it has already been withdrawn - it may take few days before it appears on your account.

 

4. Payment

Payment can be made through the chosen payment method at checkout, all of which are secure alternatives for e-commerce. The customer can choose between the following payment methods:

· With Bambora Checkout: card payments (Visa, Mastercard, Maestro), VIPPS (only in Norway), invoice (only in Norway) and Masterpass. When you accept the HoS Terms and pay with Bambora Checkout, you also accept Bambora AB's terms. Current Terms can be found here.

· With Paypal. Personal information is handled between you and PayPal in accordance with applicable laws. See PayPal's Privacy Policy here for more details.
 

We reserve an amount in your account when you confirm your booking. When the goods are sent, we charge you for exactly what the goods cost, never more than what is reserved.

 

5. Delivery

HoS reviews all orders in a thorough manner and tries to process the order within 2 to 4 working days after the order is confirmed. In the case of particularly large demand, processing of orders may take a little longer. If a delivery is suspected to be more than 30 days late, you can cancel the order. You will be informed of expected delivery details before submitting your order. Once you have submitted your order, you will receive a confirmation with the expected delivery details by e-mail, assuming that you have provided your e-mail address.

We use the following delivery options:

In Norway:

· Service package for collection point (Bring / PostNord)

· Package delivered home (Helthjem / PostNord)

 

All shipments and goods letters that do not go in the mailbox are notified by SMS. Therefore, be sure to enter the correct mobile number. To retrieve your shipment, you need the tracking number / shipment ID and identification.

All packages are at the place of delivery for 14 days before they are returned to us, read more about this below under "Uncollected package".

*Please note: International orders may be subject to customs duties, taxes and/or customs processing fees, which are determined by the destination country’s government. HoS is not responsible for customs charges incurred on international deliveries

 

Uncollected Package

Uncollected packages are not covered by the right of withdrawal. Packages that are not picked up are charged a fee. This corresponds to the costs it has incurred us to send out the package and receive it in return. If the purchase price exceeds NOK 349 (equivalent to your valuta), you will be charged a fee of NOK 349 (equivalent to your valuta). If the purchase price is less than NOK 349 (equivalent to your valuta), you will be charged with the value of the order. 

 

6. Damaged goods and right of complaint

We do the best we can to ensure that our goods maintain the expected quality and you as a customer will be satisfied when you shop at HoS. If you have received a damaged or incorrectly shipped item, please contact us with information about the error, article number and your order number. In the event of a complaint, the item is always replaced first by a new item. If this option cannot be used, we offer a full refund.

You have a two-year right to make a complaint in accordance with Norwegian law, however, the complaint must be made within a reasonable time.
 

7. Colors and dimensions
We reserve the right to make typing errors, product changes, and color deviations. We work as best we can to provide information of our products in an accurate manner. Any recommendations are only recommendations based on personal opinions. We work to ensure that our photos are as representative as possible and in accordance with reality. The color you want to see depends on the computer system you are using, and we cannot guarantee that your computer will reproduce such colors accurately.

 

8. Right of withdrawal

As a customer, you have a 14-day right of withdrawal applies to all items (except shipping and fees). The right of withdrawal expires after 14 days from that day:

1. You have received the item.

2. If you have ordered several products, but they are delivered separately, the right of withdrawal expires from the day you receive the last item.

The deadline means that you have 14 days from the day you receive the item, to inform us that you regret your purchase. Please email us at welcome@houseofsahara.com and make it clear that you wish to exercise the right of withdrawal. Here is the link to the right of withdrawal form.

You can not regret your purchase by refusing to accept / pick up your package without notifying us.

We do not exchange products (treated as a return and a new purchase)

The right of withdrawal does not apply to sealed goods which, for reasons of health or hygiene, are not suitable for return, if the seal is broken.

 

9. Return

9.1 Partial return

It is possible to return only parts of an order, even if the item (s) are part of a larger order.

Please note that we do not reimburse shipping costs related to partial returns.

 

9.2 Condition of the item upon return

HoS guarantees a full refund of the returned items in accordance with Part 8 (Cancellation of order) provided that all items are returned in the same condition as they were in when you received them. This means that the articles cannot be damaged, dirty, washed, altered or worn (other than when testing the garment), and that all labels and tags are intact.

 

9.3 How to return:

1. A packing slip is included in your shipment. In this form, tick the name, article number and number of returned items as well as the background to the return.

2. We recommend that you use the same packaging in which the item was delivered.

3. When an item is returned to us, you are responsible for the return shipping. In the event of an approved complaint, we cover the cost of return shipping. We do not retrieve items that have been returned in cash.

10. Refund

Refunds will be made within 14 days after we have received the goods in return in the same payment method with which you paid for your order. The administration of the return is performed by HoS customer service. The refund is made by our payment partner.

Any discount applied to returned item is consumption and can not be transferred to another item.

For returns when purchasing "3 products pay for 2" the following applies: When returning the free product, there is no refund as it was never charged for this product. If you return a product you have paid for, but choose to keep the free product, we will charge for the free product. This means that we only refund the difference between the free product and products you returned to us.

If you have paid with a gift card and choose to return, the balance on your discount code or gift card will be updated within 48 hours after the return is registered, provided that the gift card is still valid.

 

11. Privacy, security and personal information

In connection with the order, you agree that we store and use the following information about you:
Name, address, telephone number and e-mail address.

We store and share the information necessary to be able to deliver the item to you.

The personal information is stored at House of Sahara and stored for 2 years. The information will then be deleted from our systems.

We only work with data processors in the EU and / or countries that can provide your information with adequate protection. The data processor responsible for www.houseofsahara.com is House of Sahara.

13. Cookies

A cookie is a text file that is sent from a website to the computer where it is stored either in memory (session cookies) or as a text file (text-based cookies). Cookies are used to store the login or shopping cart while browsing various websites. If your browser is set to not accept cookies, you will not be able to place any orders on our website. You can easily change this in your browser settings. Please note that we do not use cookies to store personal information about you.

 

14. Force majeure

Special circumstances that are not under human control such as war, extensive labor dispute, blockade, fire, environmental disaster, serious infection that prevents the parties from fulfilling their obligations, may release a party from the obligations. Such exceptions apply provided that the action cannot be performed under these conditions. When exercising Force majeure, the other party shall be notified immediately of the circumstances.

 

15. Change of contract

Unless otherwise agreed, we have no right to change the terms of a sale after the sale has been completed.

17. Disputes and laws

Norwegian law shall apply to all purchases made under these terms. Disputes about purchases under these terms shall be dealt with exclusively by a Norwegian court.
